Ministry of Labor on forced retirement of public sector workers
In Azerbaijan, the age limit for employees of institutions funded from the state budget is 65 years old. Persons who have reached this age are forced to retire.
Kenul Ahmedova, who works as a doctor in Baku, said that she is 64 years old and the management of the institution where she works has already warned her about retirement. However, according to the doctor, age is not a hindrance to her work. "I perform my duties quickly and flawlessly. I have 40 years of work experience. It is not right to send me to retirement just because I will reach the age of 65. They just tell me "I need to retire", but they do not provide rational explanations of the need for this. They just offer to "voluntarily" write a statement," Akhmedova noted.
The Ministry of Labor and Social Security of the Population told Turan that the age limit for public sector employees is determined by the Law. According to the Labor Code, it is allowed to work in institutions funded from the state budget until the age of 65. The management of the institution may extend the term of work with the consent of the employee, but each time for no more than 1 year.
At the same time, it is not allowed to extend the total service life by more than 5 years. Upon reaching the age limit, in case of termination of the employment contract, the employee is guaranteed a pension. A person who has retired can work in other fields, continue his participation in the labor market and the social insurance system. For this, as the Ministry of Labor stressed, there are no restrictions.
At present, there are more than 60,000 working pensioners in the country. Persons who have retired by age, if they continue to work, receive pension allowances every 6 years on the basis of their social insurance payments. This stimulates the participation of pensioners in the labor market and the social insurance system again, the Ministry noted.
