Preparatory meeting in the case of Seymour Hazy
A preliminary hearing in the case of an employee of the newspaper "Azadlig" and leading on-line program "Azerbaijani hour" Seymour Hazy accused of hooliganism is scheduled for November 20 in the Absheron district court. According to lawyer Adil Ismailov, at the hearing defense petitioned for recognition of the illegality of keeping Hazy in custody after October 29 in connection with the expiration of the measures of arrest. However, the petition was not granted. Further protection is applied for the replacement of the arrest to house arrest, but this request was rejected.
The defense rejected the judge Shovket Najafova, because just she freed under house arrest a second defendant in the case - Maharram Hasanov.
(After the prosecution appealed against this decision, the appellate court again jailed Hasanov.) Thus the judge showed her partiality. Thenthe hearing was postponed for 20th of November.
Hazi was arrested on August 29 in a suburb of Baku. On 30 August press service of the Prosecutor General stated that Hazy hit Maharram Hasanov, a resident of Baku with a bottle on his head, and a lawsuit was filed against a journalist under the Article 221.3 of the Criminal Code (hooliganism committed with a weapon or using objects used as weapons.) Later Hasanov also was arrested, who later released for a few days under house arrest, and then re-arrested.
The reason for the incident became a claim by Hasanov, who approached Hazy street and demanded an explanation why he did not answer him to Facebook. Thereafter Hasanov attacked journalist. Defense, Hazy struck back.
Hasanov can be imprisoned maximum to one year in prison, while Hazy can be convicted for a period from 3 to 7 years in prison. -D06-
