Prosecutor General's Office on the investigation in the case the death of Elina Hajiyeva
Baku/18.07.19/Turan: The Prosecutor General"s Office responded to a statement by lawyers about not satisfying the defense petition during the investigation into the suicide case of Elina Hajiyeva, the 8th grade school student of school No. 162.
The press service of the Prosecutor General"s Office recalled that in this case, Sevinj Abbasova, the director of the secondary school No. 162 of the Sabail district of Baku, was involved in the case as the accused.
Sevil Huseynova, mother of the assignee, was informed about the results of the consideration of petitions filed by lawyers.
Despite this, the relatives of the injured party held a press conference on the biased investigation.
The prosecutor's office confirms that the defense petition for engaging an independent expert proposed by Sevil Huseynova was not granted.
This is explained by the fact that the highly qualified specialists of the Ministry of Health were included in the structure of the expert commission carrying out the forensic medical examination.
Another petition, about the confrontation between Khalida Bayramova, the first deputy head of the Sabail District Executive Authority, who was interviewed as a witness in the case and the assignee of the injured party Sevil Huseynova, was not satisfied because there was no contradiction between their testimonies.
Requests for extradition of copies of normative documents defining official functions to representatives of the assignee of the injured party were rejected in accordance with the requirements of the Criminal Procedure Law, according to which the victim or representative of his assignee has the right to get acquainted with the case file only after the preliminary investigation.
The school director Sevinj Abbasova charged under the Article 143 (leaving in danger, a person who is in a state dangerous to life or health) and 314.2 (negligence resulting in the death of the victim) of the Criminal Code. In relation to her, a preventive measure in the form of house arrest was chosen.
The defense appealed against the decision and insists on the director"s imprisonment, since, if left at liberty, she can influence the course of the investigation and the witnesses. -06D--
