The lawyer filed a lawsuit against the Prosecutor General's Office
Baku / 27.03.18 / Turan: Lawyer Yalchin Imanov sued the General Prosecutor's Office of the country. He appealed against the actions of the General Prosecutor's Office, which does not provide him with answers to requests sent 10 months ago. The statement of claim was submitted to the Baku Administrative Economic Court No. 1 on Tuesday. The matter is that on July 10, 2017, the lawyer appealed on the fact of torture of his clients - those convicted under the Nardaran events of Agil Ismayilov and Bakhruz Asgarov. However, the prosecutor's office has not yet responded.
"I was verbally told that an investigation was conducted and refused to file a lawsuit. Also, I was told that if I applied in writing, I could get a copy of the decisions. On October 20, I appealed e to the Prosecutor General Zakir Garalov in writing. I applied again on December 25, but I did not receive an answer again. Today, prosecutors conducting the case, without justification refused to issue a decision.
The head of the department for supervision of the execution of laws in the investigative and operative-investigative activities in the Ministry of Internal Affairs, Kamal Gilidjev told me that "your lawyer activity is terminated, therefore, decisions will not be given to you," the lawyer continued.
The lawyer considers the actions of the Prosecutor General's Office illegal. "As long as there is no court decision to terminate my advocacy, and it has not entered into force, I am considered a lawyer. In addition, the suspension of advocacy does not eliminate my obligations to clients. I represent these persons in the European Court of Human Rights," said the lawyer.
On November 20, 2017, the Presidium of the Bar Association suspended Imanov's powers and dismissed him from his duties. The reason for this was the publicizing of the fact of torture of activists of the movement "Muslim Unity" - Abbas Huseynov in Gobustan prison.
The Institute for Human Rights of the International Bar Association (IBAHRI) condemned the removal of a lawyer, and called on the authorities to ensure his rights. -06D-
