Baku/01.02.23/Turan: After a long break, the Serious Crimes Court in Baku continued the entertaining trial of Nelli Fabrichnaya, the head of the personnel department of the “Murov” construction company, who is accused by the owner of this company, Afgan Zeynalov, of stealing dollars in the manat equivalent of 720,000 manats. Nelli denies the accusation.

During a long trial, no evidence of breaking the safe and stealing money from there was found, just as there is no evidence that Zeynalov kept such an amount in the safe. Surprisingly, the “Murov” safe was installed by Zeynalov in the apartment of Nelli Fabrichnaya's father, although the company had its own office, and Zeynalov's brothers live in Baku. When asked about the reason for installing a safe in the apartment of the father of a subordinate, Zeynalov did not give an intelligible answer. And when asked by the judge about the origin of this amount, he emotionally stated that he had found it in a garbage dump. And the court has not yet revealed the origin of the money and the fact: Was there really in the safe the amount that appears in the investigation materials? Interesting episodes of the conflict between Zeynalov and Fabrichnaya are Zeynalov's personal relationship with a subordinate in a wide sensual range - from affection to beating a woman. Fabrichnaya reported about the episode of violence against her. Zeynalov insists that Nelly tried to poison him.

On January 30, the court heard the witness Rauf Zulfugarov, who had a close personal relationship with Nelly for several years, as the people involved in the trial say. For this reason, it is assumed that Zulfugarov knows more than others and can help the court. But this did not happen, the witness answered many questions incompletely, said that he “does not remember”, that he gave some testimony during the investigation under pressure. Judge Ganiev intends to read the testimony given by Zulfugarov during the investigation stage at the next meeting. The witness came to court with his lawyer, as he fears that charges will be brought against him for illegal storage of investigation materials. The defense considers such an accusation to be unsubstantiated. According to Rzayev's lawyer, Zulfugarov is only aware of what was brought to his attention by the defender and the investigator.

Rauf Zulfugarov said that he had borrowed $30,000 from Nelly in 2007, and he repaid the debt in full when he learned that a criminal case had been initiated against Nelly. There were other monetary relations between them, including the episode when Zulfugarov received from Nelly the amount of 120 thousand dollars. Rauf does not confirm this amount. For conversations with Fabrichnaya, Rauf started a separate cell phone number, and in general, according to Hasanov's lawyer, he has 60 phone numbers.

Afgan Zeynalov's defender also read a list of 8 cars that she considers expensive, although there were budget Korean cars among the cars. She claims that Zulfugarov owns eight cars, but Rauf admits that he owns three cars. He stated in court that, at the suit of Zeynalov's lawyer, the cars were seized with suspicion that they were bought with money “stolen” by Fabrichnaya from the head of the company. The judge noted to the lawyer that cars used by proxy could not be considered the property of the user.

Zulfugarov was in Georgia when he learned that Fabrichnaya had been beaten up by Zeynalov. From there, he advised Nellie to file a complaint with the police. He also knew Zeynalov's allegations about his poisoning, presumably by Nelly. At this point in the trial, the judge expressed surprise to the witness at what he endured when he learned about the beating of his beloved.

In questions to Zulfugarov, Judge Ganiev used the word “beloved” (sevgili) several times, characterizing the relationship between Zulfugarov and Fabrichnaya, but lawyer Rzayev protested, and the judge agreed not to use this definition anymore.

Afgan Zeynalov does not know Zulfugarov, they have not seen each other; it became known from the questions and answers between the judge and Rauf. It also turned out that Zulfugarov met with Nelly's father. Zulfugarov's brother was convicted of a criminal offense. According to the judge, Zulfugarov could have used the money stolen from Zeynalov to rescue his brother.

The trial on January 30 was notable for two warnings from the judge against the prosecution, Zeynalov. He spoke rudely about Factory, shouted at her, sitting behind glass on the dock, shook his index finger. The judge considered this behavior unacceptable.

Zeynalov is also dissatisfied. He expressed doubts to the judge about the objectivity of the trial. The owner of the firm repeated the petition for the return of the case for additional investigation. Zeynalov believes that the investigation did not reflect important aspects of the criminal case.

Judge Ganiev also denied the request of Rzayev's lawyer to transfer Fabrichnaya under house arrest. The lawyer believes that her detention for more than three months in the Baku pre-trial detention center is torture. Meetings with a lawyer are prohibited in the detention center on Saturday and Sunday, and on weekdays the lawyer participates in trials. In addition, before, being under house arrest with a signal bracelet on her leg, Nelly did not evade the investigation. But Hasanov's lawyer opposed the release of the accused from the pre-trial detention center, arguing that the court would conduct cross-examinations and then Nelly, being at home, would be able to put pressure on witnesses.
