The plenum of the Supreme Court overturned the decisions on the exclusion of Aslan Ismayilov from the Bar
Baku/12.11.21/Turan: The plenum of the Supreme Court of Azerbaijan did not approve the decisions of local courts to exclude the well-known lawyer Aslan Ismayilov from the members of the Bar Association. He was expelled on the recommendation of the Bar Association.
According to the website aihmaz.org, the decision of the European Court of Human Rights, adopted in March 2020, became the basis for the decision of the plenum. Having overturned previous court decisions, the Supreme Court returned the case for reconsideration to the Baku Court of Appeal.
The Plenipotentiary Representation of Azerbaijan to the ECHR informed the Department of Supervision over the Execution of ECHR Judgments about the decision of the Plenary Session.
The head of the law firm Visa Aslan Ismayilov was expelled from the Bar in 2013 by a decision of the Narimanov District Court. Then the court found that Ismayilov unlawfully entered the judges' room, where he insulted and threatened them.
Subsequently, the Baku Court of Appeal upheld this decision. The Supreme Court in 2014 returned the case to the Court of Appeal, which again confirmed it. Then the Supreme Court rejected Ismailov's appeal for the second time. Aslan Ismayilov filed a complaint with the European Court of Human Rights, which found a violation of the rights to a fair trial in the Ismayilov case.
The Committee of Ministers of the Council of Europe monitors the implementation of the decisions of the ECHR in relation to Ismayilov and two other lawyers - Elchin Namazov and Khalid Bagirov. All three were expelled from the Bar Association and in all these cases the ECHR ruled in favor of the applicants.
The last time the Council of Europe discussed the implementation of the decisions of these lawyers was in September this year. The final decision of the organization emphasizes that Khalid Bagirov, Elchin Namazov, Aslan Ismayilov should be reinstated in the Bar Association. -03B06-
