The Supreme Court will consider the complaint of the arrested human rights defender
Baku/01.05.21/Turan: The Supreme Court of Azerbaijan accepted the cassation appeal of the journalist and human rights activist Elchin Mamed, stated the message received by Turan from the NGO Legal Education of Youth of Sumgayit, which he heads.
The case will be considered by a panel of judges chaired by Aziz Seyidov. The date of consideration of the complaint will be determined one of these days. The defense believes that the decisions of the lower courts were illegal and insists on acquitting Mamed.
“According to the country's legislation, the commission of a crime should be determined only on the basis of evidence, and not on the basis of assumptions. The defense believes that the decision of the court of appeal, as well as the verdict of the court of first instance, are based on the subjective conclusions of the investigation, which are not supported by reliable evidence,” the statement says.
In the audio recordings and correspondence presented to the court by the “victim” Aysel Mustafayeva, there is no confirmation that Mamed committed theft of her jewelry. “The testimonies of the prosecution witnesses in court were also general in nature and they did not directly say anything about Mamed's involvement in the theft,” the statement says.
Mamed believes that jewelry and cartridges for the pistol were planted in his office.
In court, the owner of the premises confirmed that he had another key to the office and went there without Mamed's knowledge.
The defense also considers that the punishment of 4 years of imprisonment is discriminatory, since alternative penalties are also provided for under these charges.
On October 17, 2020, the Sumgayit city court sentenced Elchin Mamed to 4 years in prison, finding him guilty of “theft” and “illegal having ammunition and weapons”.
The human rights defender was arrested in March 2020. A woman to whom he provided legal assistance complained about him. Prior to that, the said woman also complained about the editor of the website criminal.az Anar Mammadov.
Mamed connects the criminal case with his human rights activities. International organizations Amnesty International, PEN, FİACAT and others condemned the arrest of Mamed. Local human rights activists recognized him as a political prisoner.-06B-
