The trial in the case of Facebook activist
Trial in the case of Facebook activist, 19 -year-old Omar Mamedov, accused of drug trafficking, continues in the Baku Serious Crime Court,
During the meeting on Thursday, lawyers have petitioned to adduce several documents: the answer from Nariman court that the Office of Narcotics of the Ministry of Interior did not appeal to check the legality of the operation on the arrest of Mammadov and his search. Under the law, if not the event is carried out without a court order , the police in the 48 hours must inform the court.
In addition, counsel submitted excerpts from several court judgments in cases in which as a witness was one and the same person - Elnur Maharramov. This confirms that this man is a " regular " police witness , said lawyer Khalid Bagirov.
The lawyer also requested to summon to court Orkhan’s father, Elyar Mamedov. Two days before the arrest of his son, he was summoned to the Chief Directorate for Combating Organized Crime (CDCOC) of the Interior Ministry and was forced to end the activities of Omar in Facebook. The defense also petitioned to summon the employees of the CDCOC as witnesses, who interrogated the father and son Mammadovs .
Lawyer Alaif Hasanov supported his colleague’s petition. However, the judge only granted the admission of documents to the case.
Further, as the witness was questioned a senior officer of the Office to combat organized crime of the interior Ministry, Ilkin Alekperov. He was one of those who detained Mamedov when exiting the dental clinic near the metro station "N.Narimanov.".
According to him, O.Mamedov himself admitted that he had drugs and they went to the police department, and no pressure was put on him. However, the defendant argues that Alekperov planted drugs in his pocket.
Police also claimed that Mamedov "behaved well" in the police. Then the lawyers asked where Alekperov known how Mamedov behaved, as he was only take the detainee to the police office. It means that Alekperov participated in the interrogation of a detainee, though he did not have such a right.
Then the policeman said he meant a "voluntary" surrender by Mammadov his mobile phone, purse and drugs.
Alekperov and could not clearly answer questions by lawyers what specifically was mentioned in the "operational information" on which Mamedov was arrested. However, the lawyer K.Bagirov explained that in the materials of the case the head of group wrote that there was an information on "selling" drugs by Mammadov.
Such a defiant behavior by the witness caused outrage among relatives and friends of Mammadov. After their protest the judge Eldar Mikayilov concluded the trial. The process will continue at 16:00 on June 6.
