Whom will the marriage contract protect?

According to the deputy, the number of divorces in the country has increased. The reason for this is the lack of responsibility of the parties, the unwillingness to overcome difficulties together. A marriage contract must be compulsory; in this case the divorce rate will decrease.

In social networks, media sites with the participation of lawyers, experts, human rights activists, representatives of state bodies, discussions began on the appropriateness of imparting an imperative nature to the conclusion of a marriage contract, the mentality of our citizens, their readiness for innovation, the psychological aspects of the proposed new model.

According to official statistics, over 63,000 marriages and over 14.000 divorces were registered in Azerbaijan last year. Not all divorce proceedings are completed with a quiet separation and the decision of the registry office. For many married couples, this procedure results in the collection of documents, judicial proceedings, the exposure of thresholds of various judicial instances. The division of property, questions about who will live with children, the recovery of alimony - all this takes a lot of time, nerves and money to pay for lawyers.

According to the press service of the Supreme Court of the country, if in 2014 in the Armed Forces were examined 8668 cases, in 2015 - 9404, then in 2016 this figure reached 10,000. 75% of all cases are civil matters. Most of the appeals are on the division of property, inheritance, alimony and divorce.

In this context, the proposal to impose a mandatory marriage contract as a preventive measure to reduce divorce seems logical and reasonable. However, unlike lawyers and sociologists, ordinary citizens adhere to

other position. Some users believe that the obligation of the marriage contract will not change the situation. Recently has appealed a tendency to present apartment as a gift to mother, father, brother, etc. Under the law, in the event of divorce, the wife and the child are not entitled to housing, because the gifted property is not subject to the section.

"Swindlers need a marriage contract. People who want to create a family do not need it! The one who talks about the contract, is confident in advance of divorce and wants to divide the money. There is a law where all the nuances of divorce are attributed, what and how to divide. A marriage contract cannot be imposed on young people, this is a voluntary matter, " say users of social networks.

The head of the department of information and analytical studies of the State Committee for Family, Women and Children Affairs, Elgun Safarov noted that the society has an ambiguous attitude towards marriage contracts. The law contains an item on the conclusion of a marriage contract on a voluntary basis. Annually in Azerbaijan there are approximately 100-110 similar contracts, which is quite low compared to the number of divorces. During divorce proceedings, these contracts can help in resolving important property and other issues. The marriage contract regulating property rights, is aimed at protecting property rights.

Head of the Public Union "Clean World" Mehriban Zeynalova believes it is necessary to carry out targeted informational and educational work among the population in order to bring to people's awareness the importance of this enterprise. It is important to change attitudes to the issue of the marriage contract. People should understand that signing such a contract does not infringe anyone's rights. On the contrary, it is a tendency to expand the rights and freedoms of the individual. Why, we have no one indignant at the medical examination for HIV, thalassemia and other diseases before marriage or obtaining a driver's license?

"One can never be 100% sure of the future, and feelings, unfortunately or fortunately, are no exception. The marriage contract can prevent the negative sides of the divorce proceedings, protects against the unscrupulous spouse. In addition, the document may address issues of inheritance, various family rights and responsibilities of spouses (for example, each of them has family expenses), but does not affect the relationship of the spouses with each other, children, relatives," Zeynalova points out.

However, independent economists advise not to force events, do not hurry with the introduction of an obligatory signing such a document. The society must be ready for innovation, the introduction of a contractual regime for the division of property in divorce. First of all, it is necessary to improve legislation, expand economic opportunities for women, improve the social status of youth, so that young people can acquire their property, car. Then there will be something to share.
