Zaur Hasanov is the victim of corruption

 Self-immolation  by Karabakh war disabled, Zaur Hasanov, reflects not only the flagrant violations of human rights. In the root of the incident is a problem of  the absence of ownership of the land section in Baku , the cause of which is corruption, Turan was told by Rovshan Agayev, the deputy head of the NGO "Assistance to Economic Initiatives."

In his view, Hasanov has  become  a victim because of confusion with the distribution of property. He signed a contract with the municipality, which eventually was recognized as lawful under the claim of the Confederation of Trade Unions. As a result,  the café owned by him  was demolished.

“Since the establishment of the institute in 1999, municipalities,  created at the territory of the capital and its suburbs, has not been determined. Although by law they had to transfer the land, to determine the geographical map showing the municipal property. This is counteracted by corrupt officials. Housing legislation can only be conducted on municipal lands. Therefore, in the case of transferring land to municipalities, the Baku Executive Power and the administration of metropolitan areas are missing these powers, which bring large illegal income," Agayev said.

On the other hand, he continued, "in the chaos and confusion  municipalities use illegal actions, and sell or provide rent-free land."

In practice this leads to conflicts. It turns out that influential government agencies claim to these lands.

For example, the state oil company SOCAR, under the pretext of restoring control, transferred  to its balance during Soviet era land, is  evicting tenants in the various towns of Baku . While many of these people have a contract with the municipality.

The same applies to the JSC "Resorts", which received land , where there was a cafe of  a businessman in Soviet times. The site was in the actual use of the citizen for many years, and is now wrong to deprive him of the land, especially as he had a contract with the municipality.

In turn , Head of Media Relations and Public CPA, Agamirov Nazim, said that the cafe was established in the territory , which is on the balance of the sanatorium "Zikh" JSC " Resorts " CPA. This area was provided by the Soviet state to the  sanatorium in 1985.

In the first half of the 1990s in connection with the Karabakh war the sanatorium was transferred  for treatment and rehabilitation of injured and disabled. Then small objects  appeared around.

After the war and the establishment of standards  the sanatorium was returned to the  trade unions.

Hasanov was  repeatedly offered to leave the cafe , and the case was eventually transferred to the court , which acknowledged the illegal seizure of territory. Complaints  of disabled man  were rejected by the  Appeal and the Supreme Courts  even in 2010; only  now  the judgment was executed.

According to the representative of the CPA , the municipality was not competent to dispose of the land, and it was confirmed by the court .

Director of the agency Turan Mehman Aliyev reminded that municipalities were originally transferred lands that had been controlled by the local authorities. Since 1998, the region's executive authority, including the capital was prohibited by law to dispose of land. But they continued to sell lands , processing them retroactively. In this sense, they interfered with the municipalities and, therefore, since 2009, this function was legislatively frozen  by municipalities.

An example of  such swindle can be called a sale  thousands of hectares of land  of agricultural presidential administration in 2003-2008 in Buzovna . Then the company's management , based on an executive order  of Azizbayov ( Khazar ) District, in  90s retroactively sold off lands.
