Dear Mr. Prosecutor General
Human rights defender Oktay Gyulalyev was hit by a car at a pedestrian crossing in central Baku on October 29, 2019. He suffered a head injury, as a result of which he is still in a coma.
On the fact, a criminal case was initiated against the driver Kanan Abdullayev, who knocked Gyulalyev down, under Article 263.1.1 (violation of traffic rules and operation of vehicles, which, by negligence, entailed serious harm to the health of the victim).
After almost 11 months, the case was never brought to court, despite the appeals and demands of the Gyulalyev family and the defense.
On July 4, 2020 Gyulalyev's lawyer Fuad Agayev and I were received by Hasan Khanifaev, the prosecutor of the Nasimi district.
At the meeting, we were informed about the progress of the investigation and the latest actions of the prosecutor's office. In particular, instructions were given to the investigative body - the Investigative Department of the Nasimi District Police Department to satisfy most of the requirements contained in the petition of the representative of Gyulalyev.
The fact is that despite Fuad Agayev's repeated appeals to the investigation and prosecution authorities, since the end of 2019, he still has not received any answers to them, although the named authorities were obliged to notify him as soon as possible of the results of the consideration of his application and complaints.
At a meeting on July 4, prosecutor H. Khanifaev assured that the investigation was interested in a full restoration of the picture of what had happened and a fair trial.
In the interests of the investigation, the prosecutor instructed the officers in charge of Gyulalyev's case to continue to ensure close communication with representatives of the victim. However, more than two months have passed, and the lawyer has not received formal responses to the petitions.
In connection with the above, I ask you to take immediate measures to satisfy all the requests of the lawyer F. Agayev, and also to speed up the transfer of the investigation materials to the court for further consideration.
