F. Agayev: EU calls fair and justified
Lawyer Fuad Agayev finds perfectly natural the statement of senior EU officials - Catherine Ashton and Stefan Fule that called on the Azerbaijani authorities to "provide prompt, fair, transparent and independent investigation into the allegations" against the head of ReAl Ilgar Mamedov and deputy chairman of Musavat Tofig Yagublu.
The lawyer considers it reasonable to call for EU officials to release the two politicians from custody.
"In this case, there is such a gross and flagrant violation of human rights that the international community had to make a special statement," Agayev said.
As for the comments from the Foreign Ministry that the EU intervenes in the investigation, it is an attempt to justify the violation of human rights, said Agayev.
Referring to the investigation itself, the lawyer accused the Department of Investigation of Grave Crimes of the General Prosecutor's Office of arbitrariness.
Charges brought by the Office for all high-profile cases have never been confirmed and there are a number of decisions of the European Court of Human Rights on unfounded criminal prosecutions.
In particular, the Strasbourg Court invalidated the prosecution of opposition activists arrested after the 2003 presidential election. Thus the Strasbourg Court found violations of the rights of the accused to a fair trial.
According to Agayev, despite strong arguments of lawyers accusing of infringement, the investigation of these cases in the courts actually rewrite the sentence in the indictments.
Recall that Mamedov and Yagublu were arrested on charges of action for breach of the peace in Ismayilli on January 24 and resisting police. -05B06-
