Hilal Mamedov accuses the judge of violating the law
The arrested editor of Tolyshi Sado Hilal Mamedov sent a letter to the head of the Judicial-Legal Council Fikret Mammadov and called him to punish the judge of the Baku Court of Grave Crimes Azer Orujov for considering his case improperly.
The appeal by Mamedov indicates that during the trial the judge blatantly violated his right to defense, he was not allowed to present evidence of his innocence, to protest the actions of the investigation, to require the logging of the testimonies, etc.
During the closed court hearings, the judge Orujov demonstrated bias against him and the lawyer, and did not comply with ethical standards. In the court records there were false and unfounded fictional expressions, while the arguments and evidence against them were ignored by the judge. The vast majority of the applications were refuted.
Judge Orujov behaves like the prosecution, indicating the custom-made nature of the case.
At the recent hearings the aggressive behavior of Orujov was even stronger, Mammadov said. The reason for this was the identification of a complete fraud and deceit charges under Articles 274 (high treason) and 283.2.2 (incitement of ethnic hatred).
"The judge is trying to justify the charges under Article 274 only on the basis of the fiction from a KGB-DHS agent provocateur Elman Guliyev, whom I had once seen in the trial of Novruzali Mamedov," Mamedov said.
"They want to fudge the charge under Article 283.2.2 on expert opinions, devoid of any evidence," he said.
Therein lies the secret of the closed trial, to hide the crime of the investigation and the trial from the public, Mamedov said.
The editor said that in his flash card there was made illegal interference and materials on teaching and research activities were replaced by a falsified document entitled "Appeal to the Talysh people." The appeal calls for Talyshs in Azerbaijan and Iran to unite in a single state and put an end to the game by these countries," Mamedov said.
In spite of this fraud, the judge rejected the request to perform an examination to check the validity of the interference in the flash card after Mamedov's detention.
Given all this, Mamedov asked to take action against the judge Orujov.
