Insanov sent to the most distant prison
Baku/07.04.14/Turan : Former Health Minister Ali Insanov has been transferred from the Kurdakhani prison to Prison N13 in the village Puta. His lawyer Togrul Babayev believes Insanov's transfer for further punishment into the most distant prison is illegal.
According to him, in accordance with Article 65.1 of the Code of Execution of Penalties of Azerbaijan, the convicted should serve their sentences close to the place of their residence. "According to the area, the closest ones are Prisons NN 6 and 10. However, despite this Insanov was sent to the most distant one. This is another biased attitude of the authorities to Ali Insanov. We will appeal this decision, " Babayev told Turan.
Babayev pointed out that Insanov was unreasonably contained in the previous detention jail for nearly six weeks after the decision of the Court of Appeal.
However, as the lawyer said, Insanov refused to participate in the trial of his complaint to the Minister of Justice and the prison service in connection with torture in Baku Administrative - Economic Court N1.
As the lawyer said, this decision is connected with Insanov's disbelief in the judiciary in Azerbaijan.
"For eight years, the Azerbaijani courts examined about 100 cases associated with Ali Insanov , and none of them ended in his favor. And on the complaint of torture on March 31 in Baku Administrative - Economic Court N 1 the listening passed without Insanov. In this situation, hope for fairness and objectivity of the court is not substantiated," said the lawyer.
However , according to the lawyer , the refusal of the trial does not mean rejection of Insanov of complaints of the torture.
"The fact is that torture of Ali Insanov was recognized by the European Court of Human Rights . If the complaint is not granted, we will turn again to the Strasbourg court . We have already sent a complaint against the continuing validity of the previous sentence," said the lawyer.
Ex-minister Insanov was arrested in October 2005 on the eve of parliamentary elections. He was accused of coup attempt. Later this charge was replaced by charges of economic crimes. Insanov was sentenced to 11 years imprisonment. March 14, 2013 the European Court found Insanov's rights infringed under Articles 3 (prohibition of torture holding) and 6 (right to a fair litigation) of the Convention on Human Rights. European Court ordered the government of Azerbaijan to pay Insanov 10,000 euros in compensation . The Plenum of the Supreme Court of Azerbaijan, November 15, 2013 sent the case back to the Baku Court of Appeal (BCA) for reconsideration .
On February 25, 2014 BCA upheld the previous verdict against Insanov.
Before that, on January 31, BCA Civil Board sent a complaint of torture from Insanov against the Minister of Justice and the prison service for consideration to Baku Administrative Economic Court N 1. -06B -
