Shirvan Administrative Court on the side of the Ministry of Emergency Situations

Shirvan Administrative Economic Court held a hearing on June 5 on the claims against the Ministry of Emergency Situations (MOE) of the 30 people who suffered during the floods in the Kura River in May and June 2010.

The court almost rejected any claim, said the coordinator of staff Kura Oktay Gyulalyev that protects the rights of the victims in the courts.

According to human rights, the court took a biased position, ensuring the interests of MOE. An example is the case Mohbet Agayev from the village Uradzhaly in Sabirabad. Emergency Ministry declared his house emergency and even through its site reported on the construction of a house for Agayev, and the judge Elkhan Amiraliyev decided to refuse the construction of his house.

Judge Rafael Eivazov rejected the request for examination of houses affected by the floods, allegedly after a period of time after the big flood examination by MOE. "This is contrary to the law of the state examination, which does not specify a statute of limitations expertise," said Gyulalyev.

Moreover, according to human rights defenders, the courts unreasonably delayed consideration of claims. "From the beginning of the trial it was dragged on in Baku, and now in the Shirvan Administrative Court, where cases are already 9 months," said Gyulalyev.

The Coordinator of Staff Kura comes to the conclusion that the courts are not going to satisfy the claims of the victims in the future. The next review is scheduled for claims on June 14.

Immediately after the court proceedings the plaintiffs, most of them members of the party New Azerbaijan, sent a telegram to the delegates of the Party Congress scheduled for June 7 against the actions of judges.

* Recall that the floods in the spring of 2010 on the Kura and Araz rivers affected houses and farms in 30 districts. To eliminate the effects of flooding from the state budget there was allocated 460 million manat. However, despite this, hundreds of people are not provided with houses and fair compensation. 200 families have filed complaints with the courts about the MOE "Irrigation and Water Management," as well as the district authorities. At present, 114 complaints are pending before the court. Two complaints have been sent to the European Court of Human Rights.
