Why does not Azerbaijan pay compensation on the decisions of the European Court?
Baku / 01.07.19 / Turan: Compensation awarded by decisions of the European Court of Human Rights (ECHR) is not paid to applicants in Azerbaijan, or is paid only in part. The lawyer Asabali Mustafayev told Turan news agency.
According to him, the negative trend began in 2017, and trend is not kept. The lawyer notes that the government has not yet paid compensation to approximately 25 applicants on decisions of the European Court of Justice in respect of Azerbaijan in 2016.
"Compensation to some of these applicants was not paid at all, but partially paid in part," he said. According to him, no appeals to the state structures are given.
The lawyer said that he applied to the Council of Europe Committee of Ministers on this matter. "The payment of compensation under the decisions of the European Court is one of the obligations of the Council of Europe member states," Mustafayev said.
A member of the National Council of Democratic Forces, Tofik Yagublu, confirmed the information that the authorities had suspended payment of compensation, started in 2016,
"I think the government is not consciously paying compensation," he said.
Yagublu believes that he has repeatedly appealed to the presidential administration on this issue. "I wrote a letter to Chingiz Askerov several times (to the authorized representative of Azerbaijan at the European Court of Human Rights - ed.), but there is no answer. I will appeal to the Committee of Ministers of the Council of Europe," said Yagublu.
Meanwhile, Azerbaijani officials claim that the government pays all compensation for the decisions of the European Court.
If compensation is not paid within 3 months, then interest accrues on this amount. -21B-
