Ombudswoman obliges government agencies to respond to media request for information
Baku/23.08.22/Turan: Aydin Safihanli, the Head of the Office of the Ombudsman of Azerbaijan, sent letters to the ministries of economy and ecology with a request to provide the Ombudswoman with answers to information requests from the Turan agency within 10 days in accordance with the requirements of Article 1.3-1.1 of the Constitutional Law on the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan.
In accordance with the Law on Access to Information, on June 24, 2020, the director of Turan IA, Mehman Aliyev, sent an information request to the Ministry of Economy and the Ministry of Ecology and Natural Resources (MENR) regarding the illegal seizure of the Caspian Sea coast. However, within the prescribed period of not more than seven days, there was no answer. An appeal to the Ombudswoman was made on August 16, who on August 17, promptly requested a response from the ministries.
Today, on August 23, the Ministry of Natural Resources told Turan that a response to the agency was sent earlier, but did not reach it for technical reasons. The facsimile response letter sent today is dated July 20, that is, the response was provided three weeks late, but never reached the agency, apparently due to the fault of the Ministry of Communications.
The response of the MENR states that the ministry is studying the environmental situation in the Azerbaijani part of the Caspian Sea and its coastal territories, monitoring is being carried out for waste management in accordance with the norms of the current legislation. The relevant structures of the ministry, as well as other central and local executive authorities, were informed about cases of environmental violations registered during the monitoring.
The response emphasizes that during the monitoring conducted in 2021 and over six months of 2022, 321 acts and 82 administrative protocols were drawn up regarding the discharge of wastewater from these facilities into the sea.
The MENR considers it appropriate that some questions of the information request be addressed to the relevant structures, since they are not within the competence of the institution.–0—
