Owner Did Not Live to See Compensation from Azersu
The owners, whose lands were alienated in connection with the construction of the Oguz-Gabala-Baku water pipeline, have not yet received the reimbursements due to them.
Turan was informed by Mirvari Gahramanly, the head of the Oilmen’s Rights Protection Committee, that land owners cannot secure their rights through court hearings, some of which have been going on for 6 years already.
But even after the court granted the claims of two residents of the Oguz district, they have not been able to enforce the verdict for 11 months already.
A resident of Gabala, Ali Soltanov never lived up to the decision on the issue of paying him the due compensation. The 36 hectare land belonging to him was confiscated for state needs as early as 2006, but no compensation was paid.
Until 2011, he applied for compensation to JSC Azersu, and later to the courts. Due to legal and non-legal obstacles imposed by Azersu, the trial of Soltanov's suit lasted 6 years.
Finally, in 2016 the Yasamal court ordered Azersu to pay him 43 thousand AZN. However, Azersu appealed against the decision, and now the case is in the Baku Court of Appeal.
After 11 years of fighting, Soltanov died in February 2017 and did not live to the compensation.
The construction of the Oguz-Gabala-Baku water pipeline started on the basis of the President's decree in 2006. For the implementation of the project, the land plots of 3,250 owners were alienated. However, the customer of the project, Azersu, has not yet paid fair compensation to many owners. -05D06--
