The Court of Appeal does not return Ali Insanov 50.000 AZN
On Thursday the Baku Court of Appeal dismissed the claim of the imprisoned former Health Minister Ali Insanov against the department to execute decisions of the Justice Ministry in the Nasimi district of Baku. Insanov appealed the decision of the Baku Administrative Economic Court of 19 July, which did not reject his claim against the Execution Department.
Insanov filed a lawsuit against the Execution Department because of not providing the court decision to return him 50.000 AZN, which is to pay Vafa Alizadeh, daughter of former presidential assistant Tariel Agayev.
Vafa Alizadeh without the knowledge of the former minister and his family registered his garage as his own, and sold it. After Insanov learned about this, he filed for her in court. Nasimi District Court issued a decision obliging Vafa Alizadeh in May 2015 to pay 50.000 AZN to the former minister. However, the decision has not yet been fulfilled.
Insanov‘s lawyers having learned that Vafa Alizadeh had stocks of the «Dekabank», asked the court to arrest them to ensure the execution of the decision. Taking into account that the Execution Department did not fulfill the court's decision, the ex-minister needs to recover from this structure is 50.000 AZN for moral damages, as well as require to fulfill the court's decision within three days.
On October 13 Baku Court of Appeal considered the matter under the chairmanship of judge Kamala Abiyeva. None of the parties - nor Ali Insanov's lawyer Agaev Shahverdi, nor representative of the Department for the execution, did not appear to court. The court, based on the notification of the parties, examined the case without their participation. After a short meeting, it was announced to dismiss the appeal. -0-
