The judge reduced the arrest of the son of a shehid
Baku/15.12.2018/Turan: The Baku Court of Appeal listened to the complaint about the administrative arrest of Togrul Gojayev, who was detained on December 11 during a protest action of members of the Martyrs' families.
On the same day Gojayev was arrested for 30 days on charges of not submitting to the police. At the trial, Gojayev said he did not violate the law, but only together with other families of martyrs he demanded payment of compensation established by the presidential decree. He did not resist, he was detained without explanation of a person in civilian clothes.
However, Judge Amir Bayramov began to reproach Gojayev for participating in the rally. "Your father did not give his life for the fact that today you are associated with some groups," said Bayramov. Thus, the judge actually admitted that Gojayev was arrested for participating in the protest.
Then he began to teach Gojayev that if an appeal was filed to a state agency, then one must wait for an answer. Gojayev, in turn, drew the court"s attention to the fact that the letter was sent to the presidential administration on October 16.
As a result, the judge decided to reduce the period of arrest of Gojayev from 30 to 15 days, "taking into account mitigating circumstances."
When Gojayev"s mother asked the judge why he left her son, the father of two young children in custody, Bayramov remarked: "I did as much as I could."
In the spring of this year, President Ilham Aliyev issued a decree on the payment of one-time compensation to the families of the dead or missing during the hostilities in defense of the territorial integrity of Azerbaijan in 1991-97 in the amount of 11 thousand manat.
Compensation payment began on October 9. However, many families were denied on the pretext that they received funds in the past. Disgruntled citizens are recommended to apply to the courts. However, to go to court, the family of the deceased should receive an official rejection of state bodies, but they do not issue a written document.
The state companies "Azersygorta" claim that in the 1990s some families were paid compensation under the law on compulsory insurance of military personnel. The amounts of the then compensations amounted to 50,000-200,000 non-denominated manats, which is equivalent to the current 10-40 manats. -06D-
