ECHR Satisfied Seven More Complaints against Government of Azerbaijan

Baku / 13.07.17 / Turan: The European Court of Human Rights (ECHR) adopted decisions on the cases of seven Azerbaijani citizens. These complaints were filed by opposition activists Abbas Fakhraddin, Sahib Rustamli, Turkel Alisoy, Sarvar Abdulali, Kochari Nagiyev, Ali Safarli and Niman Askerov on the violation of their freedom of assembly and arrest for participating in peaceful protest actions.

The ECHR found violations of the applicants' rights guaranteed under articles 5 (the right to liberty and security of the person), 6 (the right to a fair trial) and 11 (freedom of assembly) of the European Convention.

The interests of the first six applicants in the ECHR were represented by the lawyer Asabali Mustafayev. By the way, the number of cases won by Mustafayev in the ECHR reached 115. Askerov was represented by lawyer Khalid Bagirov in the Strasbourg court.

The court decided to pay Fakhraddin compensation of 10 thousand euros, and the rest - 8 thousand euros.

In six cases, compensation for legal expenses has been established for a total of 5,800 euros.

In the case of Askerov, 1,500 euros is to be paid for legal expenses.

The lawyer Mustafayev expressed satisfaction with the decision of the ECHR.

At the same time, in an interview with a correspondent of Turan, he expressed regret at the inadequacy of the amount of compensation to the applicants for violating their fundamental rights.

According to him, in similar cases of other countries, the compensation amounts to 12-15 thousand euros. However, in recent times, compensation has been reduced for Azerbaijan.

In his opinion, the low amount of compensation does not motivate the government to correct the situation.

"On the other hand, the authorities do not take general measures - they do not improve legislation and practice in the field of freedom of assembly and the applicants' rights continue to be limited. From this point of view, it would also be necessary to establish higher amounts of compensation," the lawyer believes.
