Son of the member of the National Council is taken

The judge of the Nasimi District Court, Etibar Humbatov,   adopted a decision to take the son of Gultekin Hajibayli, the former deputy, member of the National Council of Democratic Forces, and give him to the child's father, Mahmud Mehdiyev.

In an interview with Turan, the judge could not legally justify his decision.

According to the court decision, the child will be able to stay with his mother on Sundays, and five working days a week he will be with his father.

Hajibayli noted that the court adopted the decision against the will of her nine-years-old son, ignoring the opinions of experts, and the opinion of the Guardianship Commission, without conducting a thorough investigation. Earlier the bailiffs organized the child’s meeting with his father. «There was an official conclusion of psychologists that these meetings caused a significant effect on the psyche of the child," - said Hajibayli.

On the other hand, the child's father has no permanent place of residence, and for nine years he was not interested in the child, she said. Hajibayli intends to file an appeal and then appeal, and reach the European Court of Human Rights.

"They will not be able to silence me. This is an absurd and ridiculous decision. I'm ready for more serious hardship, and will not deviate from its path," said Hajibayli.

Lawyers questioned by the Turan reporter noted that the deprivation of mother of her child and giving him to father is a very rare case in judicial practice. The legislation allows it only in rare cases. In the present case, there was not a ground for such a decision.

Some time ago, in an interview with pro-government media Mehdiyev accused his ex-wife of depriving him of his home, and the opportunity to communicate with the child.
