Gurban Mammadov: Azerbaijan Has No Legal System
The act of amnesty in honor of the 90th anniversary of the former President Heydar Aliyev can not be considered an amnesty - said in an interview with TV Objective the head of law firm Chalkhan Gurban Mammadov.
According to him, the document is mutual exclusion and corruption component. So, the last paragraph of the decree provides four months of granting amnesty. At the same time, some of the prisoners have to serve six months left.
Given the fact that on the average each prison will release 150-200 people, the amnesty process can be technically completed in 10 days. Naturally, there are many employees of the penitentiary system, wanting to cash in on it.
In addition, the amnesty should apply to those under investigation, not just those for whom a sentence has been announced. There are many cases, when courts delay their verdicts to prevent including the people in the amnesty.
In the preparation of the act, first of all, they should study the cases of political prisoners and prisoners of conscience. However, the government of Azerbaijan toughens attitude towards them.
Mammadov himself served under article 178 of the Criminal Code ("Fraud"), which is always covered by amnesty, but was not taken into account by the parliamentarians. Today's prisoners of conscience and political prisoners, including the leader of the movement REAL Ilgar Mammadov, deputy chairman of the Musavat party Tofig Yagublu, seven activists of the social movement NIDA!, were not included in the lists of those amnestied either.
The reason for this is impunity. The local judicial system is not independent, as it is dependent on the whim of the highest officials of the executive authorities, the "phone right", the system of bribery, and the "law of physical force".
The European institutions are twofold to the fate of local inmates and violations of their rights. On the one hand, PACE says a total breakdown, on the other hand, the Greek judge of the European Court of Human Rights for 1 day gives withdrawal of 50 cases, and it has no consequences.
Mammadov believes that membership in the Bar Association today is an act of political agreement and its chairman Azer Tagiyev, as a member of the Central Election Commission, directly performs the will of the power.
Many prominent lawyers, who know the law better than the chairman of the body, are not permitted to the Bar or have been suspended. Among them, there is Aslan Ismailov, who was recently denied a license, Namizad Safarov, Annagi Hajibayli, Intiqam Aliyev, Khalid Bagirov, Latifah Aliyeva, and dozens of other "disobedient' lawyers. - 17D-
