Amendment to Construction Law in Azerbaijan Introduces "Construction Amnesty" Amid Concerns over Quality and Oversight
President Ilham Aliyev of Azerbaijan approved an amendment to the law on the Urban Planning and Construction Code, allowing for a new approach to the operation of construction facilities until June 1. This amendment, known as the "construction amnesty," aims to streamline the process.
Deputy Aydin Huseynov, in an interview with Turan, emphasized the need for discipline in the construction sector, focusing on a decree that permits the operation of completed non-residential buildings with positive durability and strength assessments in a simplified manner. The amendment also increases the responsibility of local executive authorities in identifying and addressing illegal construction, forbidding the connection of self-built structures to engineering and communication systems.
Economist Natig Jafarli in an interview with RadioAzadlig noted, that in the past, there was competition in building construction in Azerbaijan, where quality indicators were considered essential due to buyer concerns. However, as difficulties arose in registering buildings, some businessmen opted to allocate funds to government agencies rather than invest in quality. Jafarli believes that the new rules should enhance control and improve quality indicators, but questions whether transparent certifications will prevent bribery.
Builder Rahab Gaziyev expressed serious doubts about the earthquake resistance and overall quality of new buildings in Azerbaijan, warning of potential devastation in the event of an earthquake. He expressed skepticism that the amendments and adoption of new standards would lead to positive changes, citing the lack of strong control and the influence of monetary factors. Gaziyev emphasized the significant issue of foundations and the absence of proper documentation for many buildings. He claimed that the responsible commission avoids addressing these documents, evading accountability.
Attempts to obtain comments from officials responsible for building registration were unsuccessful, leaving concerns regarding the opinions raised in the article unanswered. The implementation of stricter oversight and comprehensive inspections, along with accountability, is deemed crucial to address the issues surrounding construction quality in Azerbaijan.
