Anar Mammadov Considers Fake about His Beating a Threat
Baku / 11.01.20 / Turan: The trial of the lawsuit filed by the owner of the Pawnshop N1 firm Malahat Gurbanova against the editor of the criminal.az website Anar Mammadov was postponed indefinitely, while there were reports on social media about the “brutal beating” of Mammadov by unknown persons and the organization of these attacks by a certain "oligarch".
Mammadov called it a fake and called on the leadership of the Ministry of Internal Affairs to find and punish those who spread this misinformation.
According to Mammadov’s lawyer Elchin Sadigov, on January 10, during a meeting of the Agdam District Court, the opposite side requested an examination to determine whether there was “slander” and “insult” in the expression Pawnshop Malahat.
“We objected to this. Pawnshop is including a legal term. In the Civil Code, in article 302, pawnshop activity is indicated as a type of entrepreneurial activity prescribed by law. Under no circumstances can this phrase be regarded as damaging the reputation and, moreover, offending honor and dignity.
Unfortunately, the court granted the request and sent the case for examination,” Sadigov said.
In connection with the appointment of the examination, the process is postponed indefinitely.
The lawyer said the plaintiff demands that the journalist be prosecuted for defamation and insult. In this case, he faces a sentence of imprisonment of up to two years and, in addition, 5.5 years of the term that he is currently serving on probation.
The defense considers the lawsuit unsubstantiated and directed against freedom of expression.
As Sadigov emphasized, according to the case-law of the ECHR, criminal prosecution for freedom of expression is prohibited.
Anar Mammadov himself on Saturday addressed a letter to the Interior Minister of Azerbaijan, Vilayat Eyvazov, asking him to investigate reports circulating on social networks that he had been attacked and severely beaten.
The journalist believes that the spread of fake is an integral part of the alleged provocations against him.
In this regard, he asks the head of the Ministry of Internal Affairs to take measures to identify and punish persons disseminating false information.
