Appeal of Blogger Mehman Huseynov about Torture Rejected
Baku / 27.04.17 / Turan: On Thursday, under the chairmanship of Gail Mammadov, the Baku Appeals Court (BAC) completed the consideration of the complaint of the head of the Institute for Reporters' Freedom and Safety (IRFS), blogger Mehman Huseynov, about torture in the police.
Recall that on January 10 this year Huseynov after the trial on the case of his detention said he was tortured in the 22nd branch of the Nasimi district police. There he was taken after he was abducted in the center of Baku in the evening of January 9 by a group of people in civilian clothes.
In this regard, the defense appealed to the Baku City Prosecutor's Office to investigate the fact of torture. However, the prosecutor's office refused to open a criminal case. The defense filed a complaint against this decision of the prosecutor's office in court. On March 28, the Sabail District Court dismissed the appeal, and the defense filed an appeal. Today, BAC upheld the decision of the Sabail District Court. The case was considered without Huseynov's participation, the lawyer Elchin Sadigov told Turan. He noted that now the blogger will appeal to the European Court of Human Rights.
The defense believes the prosecutor's office failed to provide substantiated evidence for refusing to institute criminal proceedings against torture. The prosecutor's office was presented with material evidence - a photo with signs of violence on the body of the blogger, and his clothes with blood stains.
Recall that the statement of Huseynov on torture became the basis of a lawsuit against him on charges of libel. The plaintiff was the head of the Nasimi district police Musa Musayev.
On March 3, Huseynov was sentenced to 2 years in prison. On April 12, the appellate court upheld the verdict. Many international organizations condemned Huseynov's conviction and regarded it as a punishment for blogging and human rights activities. -06B-
