Consideration of the appeal "on Ismayilly events"

Preliminary hearing to examine complaints by the convicted on the  Ismayilli events took place in the Sheki Court of Appeal on May 20. On March 17, 2013 Sheki  Serious Crimes Court  sentenced 18 defendants in connection with the riots in Ismailly region on  23-24 January 2013.

The leader of the REAL Movement Ilgar Mamedov was sentenced to 7 years in prison, the deputy chairman of the party " Musavat", Tofig Yagublu to 5 years. Other  eight people  were sentenced to eight years of imprisonment. The same number of defendants  were sentenced on probation.

Today, the  trial began  the hour and a half late, and  delivery  of the  accused was delayed. In the courtroom ten people were put in an iron cage what caused protests of the accused. Thereafter, Ilgar Mammadov , Tofig Yagublu and  Elshan Gurbanov were allowed to seat near the lawyers.

A lawyer Vidadi Jabbarov said that the prosecution remains at the same position, and considers all the defendants guilty. All lawyers made a motion to change the measure of restraint and release his client on them during the proceedings in the Court of Appeal.

A lawyer Fuad Agayev said that the minutes of the trials  were not presented the lawyers  for familiarizing. He demanded the termination of  the lawsuit and the release  of Mamedov for lack of guilt.

Mamedov himself refused to stand when the judge addressed him, saying that there is no trial, no judges, because they perform a political order; and Tofig Yagublu called  the judges cheaters without conscience.

A judge Inshallah Khudiyev rejected most applications , including the  change the preventive measure and scheduled trial on the merits on June 5.

However , the judge granted the motion for partial conducting a judicial investigation on  an appeal.

Nemat Kerimli, a lawyer  of Yagublu told Turan, that the protection  was dissatisfied with the decision of the court, but will not file an appeal to the Supreme Court , as the court is unlikely to satisfy the complaint, and the trial will be only delayed.  The European Court of Human Rights has already started on the complaint of Yagublu, the lawyer said.

* On May 22 the ECHR will announce a decision on an appeal against the arrest Mamedov. Earlier the EU foreign ministers of France and Britain , the U.S. Embassy condemned the sentence against

Mamedov  and Yagublu.  Amnesty International recognized Yagublu and  Mamedov  "prisoners of conscience." -06B -
