Judicial tyranny in Nakhchivan

Preparatory meeting in the case of the  businessman Mohammed Gurbanov  and his son-in-law Nadir Mammadov, charged under Articles 315 (resistance to authority) and 221 (hooliganism) took place  in the Sadarak regional court presided by Zulfugar Akhmedov on February 1.

On December 8, these entrepreneurs imported goods from Turkey. At customs they refuse to give

a bribe, 40 gepik per kilogram. The businessmen refused to pay and invited journalists. However, over 10 customs officers attacked and beat him. They took away from journalists their photos and video cameras, and businessmen were arrested and charged with assault on the authorities. Later a lawsuit was brought against them.

According to  the  lawyer Khalid Bagirov, a preparatory meeting was held with serious procedural violations: the defendant was not allowed to sit down and talk with a lawyer in private.

Moreover, the judge did not grant any petition – on  return the case for further investigation because the investigation did not provided  all requested documents, and the replacement of the preventive measure of arrest  with house arrest, on the resolution of photo and video, etc.

"The judge simply ignored the request, unable to endure any decisions, and finally he appointed  a hearing  for February 6,"  said Bagirov. The lawyer noted  that  the arrested men are not allowed to meet   with their lawyers. "I have faced such things for the first time in my practice," said Bagirov.

Relatives of the  arrested reported about  sharp deterioration of the arrested businessmen  due to abuse and beatings during investigation. Some defenders  have found  Mamedov and Gurbanov political prisoners because their persecution began a few days after joining the "Public Chamber". In addition, these people have always  actively defend their right. -06B-
