The court demanded from prosecutor's office to re-examine responsibility of doctors in Gulaliyev's case
Baku/15.04.22/Turan: Nasimi district court overturned a decision of the prosecutor's office on the lack of responsibility of doctors in the case of human rights activist Ogtay Gulaliyev.
Recall that in December 2021 the prosecutor's office after a year-long investigation found that the actions of doctors who examined and treated Gulaliyev within a day after the accident did not constitute a crime. The activist's family appealed this decision in court.
On April 14, the Nasimi district court of Baku, having considered the complaint, reversed the decision of the prosecutor's office. The court found that the prosecutor's office had not conducted a sufficient investigation. Materials will be sent to the prosecutor's office to re-investigate the responsibility of the doctors, lawyer Shahla Humbatova said.
The activist's family believes that it was the fault of doctors who did not provide Gulaliev with timely and quality medical care following which he fell into a coma. When the human rights activist was brought to the City Clinical Center after the accident, he was conscious and his speech was normal. However, the victim was kept there for 24 hours without a diagnosis, and then sent to a private hospital "Baku City Hospital.
At the same clinic, the activist underwent surgery after 13 hours of admission. The operation was carried out after the interference of the Ministry of Health and the participation of specialists from the Center for Neurosurgery.

On January 25, the Nasimi district court of Baku sentenced the driver, Kenan Abdullayev, who caused serious damage to the health of human rights activist Ogtay Gulaliyev, to 2 years 3 months of imprisonment with serving his sentence in a colony-settlement. The court found him guilty under Article 263.1.1 (violation of traffic rules and operation of vehicles, resulting in serious harm to the health of the victim by negligence) of the Criminal Code of Azerbaijan. Besides, Abdullayev was deprived of his driving license for three years. -06B-
