The court refused to consider the complaint of Fakhraddin Mehdiyev
Baku / 27.04.18 / Turan: Lawyer Fakhraddin Mehtiyev appealed against the decision of the Bar Association on January 22 to suspend his lawyer activity for a year. Mehdiyev was punished for publishing in the media interview of his client, the former head of the International Bank of the country Jahangir Hajiyev, sentenced to 15 years" imprisonment.
The Bar Association considered that Mehdiyev, therefore, violated professional ethics. However, the lawyer noted that his duty is precisely to protect the rights of the client and to see in this violation of ethics is absurd. Mehdiyev filed a complaint with the Baku Economic Administrative Court No.1. However, Judge Mominat Hajibayova refused on April 27 to take the case to production, and could not substantiate her decision, Mehdiyev said.
The judge stated that such cases should be considered in the general courts. "But, it's not so. There are decisions of the plenum of the Supreme Court, according to which complaints of this nature should be considered in the administrative and economic courts," Mehdiyev said. -05B-
