The Milli Majlis Adopts the Urban Development Code

 

On June 29th, the session meeting of the Milli Majlis approved in the third reading, the Urban Planning and Construction Code.  The document will be sent to the country's president for signature.

Chairman of the Parliamentary Committee for Legal Policy and State Building, Ali Huseynli, said that the Code conforms to the recommendations of the American Chamber of Commerce, Confederation of Lawyers of Azerbaijan, and the German Society for International Cooperation.

The document reflects the territorial planning, transparent and accessible public documentation for town planning, provision of urban planning and construction of opportunities for access to the objects of common use of people with disabilities and mobility of disabled, ensuring the safety of construction facilities, assessment of the impact of construction activities on the environment, and the procedure of a building permit.

The document provides permission issued for construction on a "single window" principle. Permission will be issued after the inspection of the project for compliance with standards, taking into account interested individuals.  Private owners will be able to start construction of private housing (not more than 3 story, and no higher than 12 meters) without permission documents, or notifying local authorities and relevant structures.  At the same time, housing must be built according to the developed project.

The corresponding structure of the executive power shall present within 1 month, a complaint  to express an opinion on the draft, otherwise constriction will begin without permission. Grounded claims of the executive power should be taken into consideration.

The Code reflects the principles of evaluation objects. Relatively, the main body of the executive power responsible for receiving and commissioning, will be the Ministry for Emergencies, which will issue permission for building, control it and accept facilities for putting into operation. -17B-
