Issuance of Permit to Operate Some of Construction Projects Simplified (UPDATED)

President Ilham Aliyev issued a decree on simplification of the authorization for the operation of certain construction projects
This mechanism applies to authorization for operation of non-residential buildings constructed under the project, coordinated with local authorities prior to the entry into force of the City Planning & Building Code, or unexamined construction project built on a land plot in ownership, use and lease.
It was found that such facilities include non-residential buildings, the number of floors of which is not more than 1, with no more than 4 meters in height, spans of not more than 6 meters long, and a total area of not more than 500 square meters. In addition, a simplified permit is issued to buildings, the number of floors which is not more than 2, the height of each floor is not more than 4 meters, the spans are not more than 6 meters long, and the total area is not more than 500 square meters.
The operational function of these buildings will be set by the Cabinet of Ministers. The list of operational assignments of construction projects is to be approved within a month.
Issuance of such permits is in the following order:
Prior to January 1, 2018 the Ministry of Emergency Situations (MES) at the request of the owner (customer) of the object examines the building site in terms of sustainability, strength and serviceability of its bearing structures for 20 days, as well as compliance with fire safety requirements, and readiness for operation of its engineering and communication systems. Attached to the application is the architectural and planning section on the construction site complied by the designer. At positive results of the inspection, an opinion is issued on the readiness of the object for operation.
Local executive authorities issue a permit to operate the facility and in writing notify the MES in five days. ----08D
