The Constitutional Court made a decision about one of the hotels in Baku
The Azerbaijani Constitutional Court received July 29, a decision to annul the decision of the Supreme Court dated March 14, 2014. The Court found that the Supreme Court had violated the right to property and the judicial protection of a third party in this case. From the materials of the court (http://goo.gl/OS7Eej) it was noted that OAO "Bank Technique" appealed to the trial court with a lawsuit to invalidate the auction for the sale of shares in OAO "Mehmanxana Baki" and the annulment of its results. The defendants were the BSE, former owner of 853,036 shares of the bank Rauf Kerimov, and the Department of Sabail district court bailiffs. As a third party to the court were brought the State Committee of Securities and the National Depository Center. On 30 April, 2013 the court dismissed the claim. However, Baku Appeal Court (13 September 2013) and the Supreme Court decided in favor of the plaintiff.
Hussein Marayev, the party that has bought shares through the auction conducted by the stock exchange, appealed to the Constitutional Court. He was not brought to trial, although the courts decisions directly concerned his interests.
According to the decision of the Constitutional Court , the decision of the Supreme Court in this case was annulled. The matter is subject to be reconsidered according to the order provided by the civil procedure legislation. It should be noted that the building of "Mehmanxana Baki" (formerly "Baku" hotel), located opposite a park named after Samad Vurgun was demolished in 2013 by order of the Executive Power of Baku city.--08D--
