Appeals Court uphold the detention F.Gahramanly
Baku Appeals Court upheld the decision to change the measure of restraint - arrest for a period of three months the deputy chairman of the Popular Front Party of Azerbaijan (PFPA) Fuad Gahramanli. Gahramanli was arrested on December 8th. He was charged under Articles 281.1 (calls for violent seizure of power and the overthrow of the constitutional order) and 283.2.1 (inciting religious hatred) of the Criminal Code of Azerbaijan. The investigation alleges that Gahramanli made these appeals on social networks on the Internet. Gahramanli denies the charges, and says that in social networks he only expressed criticism. The lawyer Fakhraddin Mehdiyev noted that the accusation of Gahramanli has no legal basis because the publications of opposition contained a criticism of individual officials and political analysis. The lawyer regarded as unreasonable an extreme preventive measure, and intends to appeal against the arrest Gahramanli in the European Court of Human Rights. He believes that with respect to Gahramanli has been violated the Article 5 (right to liberty and security) of the European Convention for Human Rights and Freedoms. In addition, the defense put forward a new motion to change the measure of restraint on house arrest. -03C-

On January 15, the Tbilisi Court of Appeals rejected the appeal of Afghan Sadigov, the founder of the Azel TV website, who had protested his extradition to Azerbaijan. Sadigov’s wife, Sevinj Sadigova, stated that this was the final judicial instance in Georgia making a decision on the case, Turan reported. On the other hand, lawyer Mariam Kvelashvili informed Turan that the defense would continue legal steps to prevent the extradition of Afghan Sadigov. On January 15, the Yasamal District Court rejected the motion to change the detention measure for Azer Gasymly, the director of the Institute of Political Management, his lawyer, Agyl Laidj, to Turan. "Azer Gasymly stated during the trial that the charges against him were fabricated and related to his socio-political activities," the lawyer said. An appeal will be filed against the court's decision.
