Arif Hajyly's son arrested for two months
Baku/02.11.23/Turan: On November 2, the Yasamal court of Baku arrested Orhan Hajyly, the son of the head of the Musavat Party Arif Hajyly for 2 months. He was charged under Article 263.1 (violation of traffic rules that caused less serious harm to health) and Article 264 (Leaving the scene of a traffic accident) of the Criminal Code of Azerbaijan. Lawyer Nemat Kerimli stated that the criminal prosecution was unjustified, stressing that the accident was not the fault of O.Hajyly. "Video footage of the accident on October 11 was distributed on social networks. Orkhan was driving his own way, but another car abruptly left the road in front of him and began to turn around in the wrong place. Orkhan's car crashed into this car, flew off to the side and hit a parked car," the lawyer told reporters.
He pointed out that there was no victim in court. In general, as a result of the accident, there were no injuries. However, 20 days later, a "victim" appeared in the case, who allegedly sat on the sidewalk and suffered due to a "chain accident". As for the damage to other cars, the owners of two cars have been compensated, another car is under repair. In addition, the articles of accusation incriminated to O. Hajyly relate to crimes that do not pose a great public danger, and provide for alternative types of punishments that are not related to imprisonment. In this case, the detention of the accused is unjustified. In general, according to these articles of the Criminal Code in the judicial practice of Azerbaijan, the accused are not detained.
Orkhan Hajyly denied the charges as saying that he was being persecuted because of his father's political activities. The defense intends to appeal the court's decision. The Musavat Party regarded the case against O. Hajila as political aimed at putting pressures on the Party and its leader Arif Hajyly. -16B-
