Baku / 29.10.20 / Turan: The European Court of Human Rights (ECHR) accepted Azerbaijan's petition to apply interim measures to Armenia in accordance with rule 39 of the Court's Rules of Procedure due to the conflict in Nagorno-Karabakh.

The message of the ECHR reads that Baku asks the Strasbourg court to oblige Yerevan "to stop rocket and artillery attacks from the territory of Armenia and the occupied territories of Azerbaijan on residential areas, public buildings, cemeteries, other civil objects and infrastructure of Azerbaijan." 

In addition, Azerbaijan considers it necessary to stop military, political, financial or any other support for criminal structures in the occupied territories of Azerbaijan.

Baku also asks the ECHR to oblige Armenia to stop sending military forces, weapons and so-called volunteers, who are in fact mercenaries, to the sovereign territory of Azerbaijan, and refrain from appeals to the presence of Armenian citizens or foreign citizens in Azerbaijan.

Finally, Azerbaijan asks the ECHR to oblige Armenia "to remove its military forces and equipment illegally located on the territory of Azerbaijan" and "to abandon the policy of hatred directed at Azerbaijan and its citizens."

The message of the ECHR  noted that "the request will be considered soon."

The Court notes that on September 29, 2020 “in the case of Armenia v. Azerbaijan (No. 42521/20)” it called on the parties to refrain from taking any measures, in particular by the military that could entail a violation of the rights of the civilian population under the Convention. He also called on both parties to comply with their obligations under the Convention, especially with regard to article 2 (right to life) and Article 3 (prohibition of torture and inhuman or degrading treatment or punishment) of the Convention.

Under Rule 39 of the Rules of Court, the ECHR can apply interim measures to any state party to the European Convention on Human Rights. Provisional measures are applied only if there is an imminent risk of causing irreparable harm.

Since the beginning of hostilities on September 27, 90 civilians of Azerbaijan have died and 392 have been wounded. 2,406 private homes, 92 apartment buildings and 423 civilian infrastructure were destroyed. — 06D-
