Hafiz Hajiyev should be punished for violent behavior on television , says expert
Baku/20.09.13/Turan : In the course of the September 19 presidential debates on public television there were documented violations of the provisions of the Electoral Code in relation to the election campaign. Such an opinion in an interview with Turan gave expert in the field of elections , Head of the "Law and Development" Hafiz Hasanov .
It should be noted that during the debates the head of the party Modern Musavat Hafiz Hajiyev hit with offensive and defamatory attacks on the National Council of Democratic Forces ( NCDF) and its candidate for president Jamil Gasanli and other opposition leaders.
Moreover, Hajiyev was to interfere with the performance of Gasanli , depriving him of air time, which , despite the insistence Gasanli was not restored.
According to the expert Hasanov , there is a violation of Article 88 (Prohibition of abuse cases in the conduct of the election campaign ) of the Electoral Code (EC).
He noted that in such cases , in accordance with Article 88.7 of EC the relevant election commission can bring to administrative responsibility the abusive presidential candidate.
Moreover , in this case there is reason to cancel the registration of the candidate on the basis of Article 113.1 of EC.
According to Hasanov, under the law in the course of the debate there must not be insulting the honor and dignity of the candidates or slanderous statements.
"During yesterday's debate just such a case took place.
One candidate demonstrated aggressive behavior towards another . He threw a bottle of water . According to the legislation a candidate subjected to insults and slander should apply to the CEC. This body , in turn , shall issue a warning candidate who has committed illegal actions by law . In addition, in view of the availability in these actions in the CEC the offended should contact the police, " said Hasanov.
According to him, in the course of committing an aggressive action by one of the candidates the TV presenter was to stop the broadcasting time and immediately turn off the microphones, and the person who insults another candidate had to be taken out of the room.
ITV did not fulfill its obligations and committed an insult to the candidate on the air .
On the other hand, the person subjected to abuse should have been given a response time that he responded to the insult.
According to Hasanov , the candidate subjected to insults can apply directly to the court.
As for the behavior of the TV presenter , then this issue should be taken by the media group at the CEC.
According to the expert , Gasanli may require the CEC also to restore his airtime broken by Hajiyev .
The expert also called a form of illegal allocation of free airtime the speech at the round table.
Since the roundtable format is used to insults and attacks on one candidate from the other candidates , it's already been tried in previous elections . The law does not provide for such a format .
Candidates should have an opportunity to present their platforms and ideas of the voters . For debate is the public television they can allocate separate time for candidates communicated their position on specific topics and current issues. -16B06-
