Ministry of Taxes: Criminal investigation against Turan continues
Baku / 02.10.17 / Turan: The Ministry of Taxes notified the Turan news agency about the continuation of the investigation into the previously initiated lawsuit against the agency. A letter signed by Deputy Minister Namig Aliyev, dated September 26, was received by the agency on October 2.
The letter also notes that, since September 11, against the director of the agency Mehman Aliyev, the preventive measure "arrest" has been changed to the preventive measure "about not moving to another place," which means a ban on leaving the country.
The letter was drawn up the day before the court hearing on the agency's complaint against the unlawful actions of the Ministry of Taxes, which was held on September 27.
On August 7, the Baku Local Taxes Department made a decision that the agency evaded from paying taxes during the period from July 31, 2014 to July 31, 2017 for the amount of 26 907 manats, and applying a fine of about 10,000 manats. The total amount of the claim to the agency was about 37,000 manats.
The agency called this decision illegal, and appealed to the Baku Administrative Economic Court No.1 on 14 August. The court session was appointed only for September 27, and was held with the participation of the parties.
On August 8, the Department for Preliminary Investigation of Tax Crimes under the Ministry of Taxes started an on-site inspection after the fact. In parallel with this, a lawsuit was filed against the agency.
The same department on August 16 canceled the audit for 2014-2017 and appointed an audit from October 1, 2010 to August 1, 2017.
The agency also protested this decision in court. The meeting is scheduled for October 11.
On August 24, the Department of Preliminary Investigation of Tax Offenses of the Ministry of Taxes presented Mehman Aliyev charges under Articles 213.1 (tax evasion), 308.1 (abuse of power) and 192.2 (illegal business with the extraction of large income) of the Criminal Code. By a court decision he was arrested for 2.5 months. The measure of restraint was changed on 11 September.
On the same day, the Ministry of Taxes liquidated the decision on the agency's debt of 37,000 manats, and bank accounts were unlocked. However, on September 15, again restored the decision on the debt.
The banks where the agency accounts are located were ordered to withdraw the incoming funds to pay off the tax debt.
Practically since August the financial and economic activity of the agency remains paralyzed. Employees of the agency have been sent temporarily to unpaid vacation since September 5, and partially continue work on a volunteer basis. -0--

According to the Turkish newspaper Sabah, officials from the Istanbul Prosecutor's Office's Anti-Smuggling Unit have detained an Azerbaijani citizen with a large shipment of gold. The detention took place near the Vadi İstanbul shopping center in the Sarıyer district, where a taxi was stopped. During the search, 70 kg of gold was found. The Azerbaijani citizen in the vehicle claimed ownership of the cargo and also stated that he was a diplomat. The investigation by the prosecutor's office is ongoing, reports Sabah newspaper. The media outlet does not disclose the name of the "diplomat," only his initials – M.G.Ş. The Azerbaijani Ministry of Foreign Affairs has declined to comment on the situation.
