Tax Inspector Threatens Lawyer Elchin Sadigov
The head of the Rights and Education Protection Society, lawyer Elchin Sadigov asked the Minister of Taxes Fazil Mammadov to investigate the threats against him by an officer of the ministry. The threats come from a man introducing himself as an employee of the Department of the Preliminary Investigation of Tax Crimes in the Ministry of Taxes, Vugar Safarov.
Sadigov said that his NGO passed state registration on April 19, 2006. The NGO is not a commercial entity and is not intended to generate revenue. It has not entered into any employment agreements with anyone, has not made any payment or engaged in gainful activity.
At the same time, on a quarterly basis Sadigov timely sent tax statements to the territorial department of the Ministry of Taxes N 12.
However, from September 25 Sadigov began receiving phone calls from a mobile phone 994553131325, which he did not answer, because he was abroad.
Subsequently, from the same number he received SMS with the requirement to provide reports for the 2nd and 4th quarters of 2012, as well as to provide a written explanation.
Sadigov said that the reports were sent by mail and reminded that, if such statements were not available, the territorial administration of the Taxes could require a fine from him.
Sadigov said that an officer of the Investigation Department of the ministry had no right to demand explanations from him on the tax statements, and he does not intend to visit the department.
Sadigov said that reports that he has no tax liability for the 2 and 4 quarters in 2012 were sent on July 19, 2012 and January 21, 2013 by mail.
However, on October 31 at 18.40 and later Vugar Safarov again called from the phones +99450 3157722 and +99455 3131325 and threatened to take the counsel in a compulsory way to the Department. After receiving a negative response from Sadygov, he began insulting him.
The lawyer said that he can only be delivered by force to the Department in the event of criminal proceedings against him. Employees of the department do not have the right to forcibly take people if there is no clear evidence of a crime.
The lawyer called on the minister to take action against this employee and put an end to his illegal activities.
