Fuad Agayev: Ilgar Mamedov must be released
Decision of the European Court of Human Rights in the case of the leader of "REAL" Ilgar Mammadov is considered final and came into force, said a lawyer Fuad Agayev commenting on the refusal of the Grand Chamber to consider the peal of the Azerbaijani government in the case of the leader of "REAL".
On August 8 the Azerbaijani government filed an appeal against the decision by the ECHR on 22 May. However, on October 13 a panel of five judges decided to deny the appeal. This means that the decision of May 22, comes into force.
According to the lawyer, the Government of Azerbaijan for three months must perform actions arising from the actions of the ECHR. "I do not concern the material aspect of the decision. I think that this is not the main issue. The most important thing is that the decision of the European Court stated that pretrial detention of Ilgar Mammadov, since February 2013, was completely illegal.
The judgment states that during the arrest of Mamedov there was not ground to consider him a suspect in the alleged his actions - committing mass riots, acts of violence against the police and others.
Therefore, the decision of Nasimi Court of the Criminal Division of the Baku Court of Appeal in relation to Ilgar Mamedov were recognized by the ECHR not legal," said Agayev.
Based on the foregoing, the Supreme Court and its chairman Ramiz Rzayev must revise these court decisions and undo them.
"The decision of the European Court stated that for the arrest of Ilgar Mamedov there was not reasonable evidence. Arrival Ilgar Mamedov to Ismayilly, gathering strangers around him, management, and turning them allegedly against the government is groundless accusations.
Upon arrival of Ilgar Mammadov to the region there were not disturbances, and the chief executive of the region said that everything was calm, and no events could happen," said Agayev. He also pointed to the presence of video proving the version of prosecution.
"The court also viewed footage from the ATM of Unibank. They clearly show that during Mamedov’s stay in Ismayilly there were no disturbances. If the Azerbaijani government is committed to its obligations, Ilgar Mamedov should be immediately released," said the lawyer.-03B-
