Administrative Court No.1 breaks a trial on Aliyev's lawsuit against Abutalybov
Baku/15.05.17/Turan: The First Administrative Economic Court No.1 of Baku disrupted the claim of Mehman Aliyev, the director of the Turan agency, against the head of the Baku Executive Power Hajibali Abutalibov.
Judge Elchin Mammadov, who was considering the case, sent a late notification to Aliyev about the court hearing on May 12, while at a court hearing on March 31 he was informed that the director of Turan would be on a foreign mission at the specified time.
It should also be noted that the notice is dated 1 May. However, the seals on the envelope indicate that post office No.14 sent Aliyev's notice on May 8, and on May 10 it went to post office No. 0. The letter was forwarded to the agency on May 12 on the day of the hearing.
At the hearing on March 31, the defendant or his representative did not arrive without notifying the court about this. At the trial Aliyev stated that he would be on a business trip on May 9-12, and asked to take it into account. Judge Mamedov also promised to send a letter to Baku's Executive Power so that the executive power respond to the information request before the next hearing. However, no answer was forthcoming.
The subject of the claim is the violation by the Executive of the capital of the law on freedom of information, and specifically the lack of response to the information request.
The information request was sent to the head of the Executive Power of Baku, Hajibali Abutalibov, on January 24 this year, and the lawsuit was submitted to the court on February 23.
The information request of Baku's Executive Power was about the fate of two apartments on the 8th and 9th floors of the building along Subhi Street, 2 in Buzovna settlement, which were affected by the fire on December 18, 2016. The building is under the jurisdiction of the First Special Housing and Communal Economic Association of the Housing and Communal Economic Department of the Baku Executive Power.
It should be noted that as a result of the joint struggle of the agency and residents of the house for their rights, the Executive Power carried out repairs, restoring windows on the balconies of houses, and repairing the damaged facade of the building. However, it was not the role of the court.
The practice of information requests by journalists to state structures and the actions of the courts shows the deplorability of the situation and the paralysis of the Law on Freedom of Information in Azerbaijan. -0-
