Appeals of young activists rejected
Today the Baku Court of Appeal considered complaints of youth activists Giyas Ibragimov and Bayram Mammadov on their arrest for four months. Both young men deny the charges against them in drug trafficking, and say that the real reason for their arrest is graffiti on the monument to Heydar Aliyev.
The complaint of Mammadov was considered the composition of judges headed by Gadim Babayev. At the trial Mammadov said that after the arrest on May 10 in the 12th police station, City Police Department and the temporary detention of Narimanov District Police was tortured and asked to investigate these facts. The judge said that the complaint will be investigated by a court of Khatai. However, the lawyer Namazly said that the investigation is delayed, and the injury on the body will soon disappear.
The lawyer also pointed out the groundlessness of arrest, because the investigation could not prove the guilt. These are only the testimonies of witnesses and the reports drawn up by the police.
"As for the charges in the detection of one kilo of heroine from each of the accused, they are highly questionable, since such amount of drug worth a lot of money, which ordinary students cannot have.
They were arrested a few hours after the appearance of graffiti on the monument to Heydar Aliyev, the young people were detained almost simultaneously. All this suggests that the charge of drug is far-fetched," the lawyer told Turan. However, the court rejected the appeal.
According to Namazly, his client was visited in prison by the experts of the UN Working Group on Arbitrary arrests, who have recorded signs of torture. Namazly also saw bruises on Mammadov’s arm.
As for the statement of the Ombudsman about the absence of injury to the activists, the lawyer told Turan, that the representatives of the Ombudsman photographed places on the activists of the body where there was no bruising.
The lawyer expressed regret that defenders are not allowed in jail and in court with the phones so that they can fix the traces of violence. In turn, the lawyer Elchin Sadigov participated in the appeal court in the trial of Ibrahimov said: "It was enough that the representatives of the Ombudsman shot the purulent wound on the arm of a young man." Appeals from both young people were rejected. Lawyers will prepare a complaint to the European Court of Human Rights.
