Claims against doctors at the trial in the case of Ogtay Gyulalyev
Baku / 16.11.20 / Turan: On November 16, A trial on a criminal case on a car collision with human rights activist Ogtay Gyulalyev on October 29, 2019 was held in the Nasimi District Court on 16 November. It is the third trial, the previous one was held on November 13. Today's session, chaired by judge Azer Tagiyev, focused on the testimony of Firuza Gyulalyeva, Ogtay Gyulalyev's wife, and viewing video footage of surveillance cameras from the October 29 incident. The wife's testimony concerned two episodes related to the actions of the medical staff at the Clinical Medicine Center No. 1 and the Baku City Hospital. According to Gyulalyeva, her husband was in a state of coma, which will continue for more than a year, due to the fault of the doctors. She believes that the court should clarify the reason for this action by the medical staff, and especially the Baku City Hospital.
The operation to remove the hemorrhage in the brain was done 18 hours later, although measures had to be taken promptly after he lost consciousness already during transportation from the Clinical Medicine Center No. 1 to the Baku City Hospital, Gyulalyeva said. At the trial, it was reported that the prosecutor's office brought the issue of the responsibility of doctors into a separate office work.
One nuance was noticed at the trial - the investigation established incoming and outgoing calls from Ogtay Gyulalyev's phone, but this was not done over the phone of the accused. Fuad Agayev, a lawyer for the Gyulalyevs, filed a motion to obtain information from a mobile operator about incoming and outgoing calls from the phone of the accused Kenan Abdullayev. Judge Azer Tagiyev granted the petition and appointed the next court session for December 4.
Because of an accident on October 29, 2019, Gyulalyev received a head injury and fell into a coma a few hours later. Taxi driver Kanan Abdullayev was brought in as a defendant in the case. Initially, he was charged under Article 263.1 of the Criminal Code of Azerbaijan (violation of traffic rules, resulting in negligent harm to the health of the victim of moderate severity), but now he is charged under Article 263.1-1. Of the Criminal Code, which takes into account the infliction of grievous bodily harm to the victim.
