Baku/21.11.18/Turan: The Administrative and Economic Court has practically disrupted a court hearing on the suit of the Turan Information Agency against the Cabinet of Ministers. The notice of the court hearing scheduled for November 14 was delivered to the agency on November 19. It was signed by Judge Elchin Mamedov on October 25, 2018. The stamps and comments on the envelope indicate the path and time the envelope is in transit from the court building to the agency office, the distance between which in 1.2 kilometers.
So, the judge signed the notice on October 25th. The letter leaves the post number 1022 after six days at the post number 1014, which arrives there on 3 November. This number was erroneously specified by the court - the letter should have been sent to the post number 1010. Further, only on November 14, the post No. 1004 sends a letter to the post No. 1010, which arrives here on November 17, 3 days after the court hearing.
This could be called a possible error, if not the following things:
1. Why did not the court send an electronic notice?
2. Why did not the court send SMS?
3. The court without the participation of the plaintiff did not satisfy the claim of the agency?
4. Why does the post № 1014 send a letter to the post № 1010 only on November 14 - on the day of the court hearing.
The experience of the Turan agency shows that the courts take the side of state structures when considering such issues. For example, in 2016-2017, 11 court hearings were held only to receive an answer to 5 questions to the Azersu state company, while others were not satisfied at all under various pretexts. This was despite the fact that the responsibility for refusing to respond to information requests was legally tightened.
Turan after receiving a formal court decision intends to challenge the decision to dismiss the claim.
The lawsuit was filed in accordance with the law on freedom of information and in connection with the violation of the agency"s rights to receive a response to an information request. The request was made on the basis of the article "In Sumgayit, the apartment of the family of the shahid (martyr) was occupied by the refuges from the region of Gubadli", which was published on September 19

There were two questions in the information request: what measures will be taken in connection with the strained situation, and also whether the housing rights to the martyr family be restored by giving it an apartment.
On this issue, claims were filed against the State Committee on Refugees and Forced Migrants, as well as against the Executive Authority of the city of Sumgayit.
In connection with the refusal to respond to other information requests, lawsuits were filed against the Ministry of Education, and the state company "Azersu".- 0-
