Defendants on Nardaran Case to Pass Medical Examination

In the trial of the "Nardaran case" on August 26 the court granted the request for a general medical examination of the accused in relation to their complaints of torture.

The attorney for Shamil Abdulaliev, Zibeyda Sadigova, also petitioned the conditions for the withdrawal of two bullets from her client's body through surgery. This request was also granted.

In addition, the accused Deputy Chairman of the movement Muslim Unity, Abbas Huseynov, said he wrote a complaint against the presiding judge at the trial, Alovsat Abbasov, to the Chairman of the Baku Court of Grave Crimes, Mahmud Nabiyev.

Huseynov in particular complains about the 'not objective judge.' According to the defendant, the judge tries to protect victims and witnesses, employees of the Main Department for Combating Organized Crime (MDCOC) of MIA, from questions exposing them.

The judge promised that the complaint will be handed over to the head of the Baku Court of Grave Crimes.

Later at the meeting the employee of MDCOC MIA, Elchin Taghiyev, continued to answer the questions of the accused and the lawyers. He spoke at the previous meeting as a witness and a victim.

The lawyer for the leader of the movement Muslim Unity, Taleh Bagirzadeh, Elchin Sadygov, asked that, whereas all the security forces were wearing body armor during the raid, then how one of the killed police officers was shot in the belly.

In response, Taghiyev said he was wearing a bulletproof vest and did not know about the others.

The accused Jabbar Jabbarov said Taghiyev was one of those in the furniture van, who used torture against the believers, when the detainees were taken from Nardaran to MDCOC.

Further, testimony was given by another MDCOC employee, Hikmet Aliyev, who acted as a witness and a victim.

He repeated the words of his colleagues that the believers in Nardaran were armed and one of them, the accused Ibrahim Khudaverdiyev, allegedly had a knife and a grenade in his pocket, which Aliyev seized from him in the yard.

Khudaverdiyev said he was not detained by Aliyev. Actually, he was detained inside the house and not in the courtyard.

Aliyev denied the use of torture against the detainees. Also when asked by the lawyer Imanov what kind of loss he suffered, the victim MDCOC employee said it was 'moral loss.'

 The accused, Ali Nuriyev said Aliyev handcuffed him in MDCOC and together with Kerim Alimardanov they passed him through an electric current. Nuriyev showed signs of violence on his hands.

Rasim Jabrayilov also named Aliyev among those who tortured him.

However the MDCOC officer said he was working 'in another department,' and was only involved in this case during the special operation.

At the same time, Aliyev said that as a 'victim' he 'does not have complaints' against the accused and the question of their punishment 'should be decided by the court at its discretion.'

The process will continue until 31 August.

* In the course of a special operation in Nardaran on November 26, 2015 six people were killed in the crossfire, including two policemen. Total in this case about 70 people are involved, mostly members and supporters of the movement Muslim Unity. They are accused under a number of articles of the Criminal Code:. an attempt to forcibly change the constitutional system, creation of an organized armed criminal group, etc. Currently, the Baku Court of Grave Crimes holds the trial of 18 people accused in the case. Among them is the Deputy Chairman of PFPA, Fuad Gahramanli, who is accused of anti-state calls, inciting religious hatred, and calling for riots. In fact, Gahramanli wrote an appeal to the Nardaran residents, urging them to defend their rights, on his Facebook page. -06D--
