ECHR Communicates on One More Complaint of Afghan Mukhtarly
Baku / 06.05.18 / Turan: The European Court of Human Rights (ECHR) started a communication on one more complaint of the Azerbaijani journalist Afghan Mukhtarly, who is currently serving a prison sentence. The complaint accepted for consideration is connected with his detention during the protest rally of the opposition in Baku on April 2, 2011. The lawyer Fariz Namazly reported this on his Facebook page.
Mukhtarly was kept in the Sabail District Police Department in cramped conditions in a room together with a large group of other detainees for 12 hours, after which they released him, making a warning.
The journalist complained about the illegality of his detention and the conditions in the detention center.
The ECHR sent questions to the Azerbaijani government regarding the investigation of the violation of Mukhtarly's rights under Articles 3 (prohibition of torture) and 5 (right to liberty and security of the person) of the European Convention.
"Regarding detention terms, the ECHR has already taken two decisions concerning Azerbaijan - in the case of the former Health Minister Ali Insanov, who complained about the conditions of detention in the detention center and the prison, and Shakir Rzakhanov, who complained about the conditions in the Gobustan prison. Mukhtarly's complaint is the first one investigated by the ECHR in cases where participants in rallies were kept in large groups in cramped conditions in police custody," Namazly wrote.
Recall that in June, the ECHR began examining Mukhtarly's complaint of his abduction in Tbilisi and arrest in Azerbaijan. The Strasbourg Court gave priority to this case.
It should be reminded that Afghan Mukhtarly was abducted on May 29, 2017 in the center of Tbilisi and delivered to Azerbaijan across the border. The next day he was arrested on charges of smuggling 10,000 euros, resisting the border guard and illegally crossing the border.
Mukhtarly was persecuted in Baku, so he moved to Tbilisi and worked with opposition Azerbaijani publications, investigating corruption in the highest echelons of power in Azerbaijan.
In January 2018, he was sentenced to 6 years imprisonment. In April, the court of appeals upheld the decision. International and local human rights activists recognize him as a political prisoner. -03D06--
