ECHR Investigating Complaint from Abdul Abilov
The Strasbourg Court has started communicating on the complaint from the blogger Abdul Abilov. Abilov's legal representative in the European Court of Human Rights (ECHR), Khalid Bagirov told Turan.
Recall that Abilov was arrested on November 22, 2013 on charges of drug trafficking on a large scale. On May 27, 2014 he was sentenced to 5.5 years of imprisonment.
Abilov pleaded not guilty, claiming that his prosecution is due to dissatisfaction with the authorities, which he expressed in social networks. Recall that he was the author of the Facebook pages Stop Sycophants that criticized officials and Stop Election Fraud that criticized violations of the law at the presidential elections of October 9, 2013.
As Bagirov explained, the ECHR is investigating the complaint from Abilov under Articles 5 (right to liberty and security) and 18 (limits for the use of restrictions on rights) of the ECHR.
According to Bagirov, recently ECHR has been considering the complaint of Azerbaijani activists and is investigating violation of rights on Article 18.
Earlier this took place against the human rights defenders Leyla and Arif Yunus, and Intigam Aliyev. Establishing violation of rights under article 18 means persecution on political grounds and provides demand for the immediate liberation. Generally six decisions under Article 18 have been taken by the ECHR, related to complaints of unlawful arrest. Two cases concerned statements on violation of the rights. Regarding the leader of the movement Republican Alternative Ilgar Mamedov, the decision was taken still in May, 2014. But he is still under arrest. The ECHR also decided on the complaint from the human rights activist Rasul Jafarov. On the day of the announcement of this decision, he was released on pardon. Four other decisions of the ECHR under Article 18 were complaints from prominent political and public figures of the former Soviet Union - Vladimir Gusinsky (Russia), Sergei Cebotari (Moldova), Yuriy Lutsenko and Yulia Timoshenko (Ukraine) and they were all fulfilled, continued Bagirov.
The ECHR has been sent another complaint from Abilov against the judgment on the merits of the criminal case, said Bagirov. -06D--
