Housing rights of Baku residents are violated for the construction of the Museum of Vicry
Baku/20.06.22/Turan: The city authorities of Baku have chosen a place in the Khatai district of the capital for the construction of the Museum of Victory. At the beginning of 2022, residents of an 11-storey residential building on Yusif Safarov Street, at the intersection with Afiyaddin Jalilov, were informed about the need to sell his apartments to the executive power of the Khatai region, and move out. The Museum of Victory will be erected on the site of the house.
The executive power bought three apartments in the house and proceeded to destroy the premises in order to force the rest of the tenants to hurry with the sale and eviction.
In this regard, 16 residents of the house signed an agreement with lawyer Javad Javadov to resolve the conflict in court. On January 10, the Administrative Court ruled that destruction without the permission of the residents was illegal, and ordered that the demolition of the building be stopped.
However, as lawyer Jafadov told Turan, the district police officer recently gave the residents time until tomorrow, after which they will be forcibly evicted from the house. Thirty families live in the house.
Javadov appealed to the district police and executive authorities with a notification about the 29th article of the Azerbaijani Constitution, which prohibits the deprivation of citizens of property rights without a court decision. He also recalled that according to Article 164.1 of the Civil Code, deprivation of property without the will of the owner is considered an offense, and homeowners have the right to use force to protect their home. The lawyer demands that officials stop arbitrariness.
Javadov asked President Ilham Aliyev to intervene and protect the rights of the residents. The lawyer also sent relevant appeals to the Ministry of Internal Affairs and the Executive Office of Baku.
In a conversation with Turan, Javadov said that the Khatai district executive office offers residents to sell apartments at a price of 2,200 manats per square meter, without taking into account the number of floors and the state of repair. This price is much lower than offers in this and other central regions of Baku.
He believes that the authorities should negotiate with the residents, stop the confrontation, and determine an acceptable price for them, and then the citizens themselves will leave the apartments. According to him, in recent days, other residents of the same house have been added to the existing clients of the lawyer, who want to draw up an agreement with him on the protection of rights in court.
The Executive Power of the Khatai district told journalists that the building at the indicated address would be demolished in order to build the Museum of Victory on this site. Construction is carried out according to the state order. The building is being demolished because its appearance does not correspond to the design of this place in the city. To meet the rights of residents in the Executive Power, a commission has been created, and the amount of compensation has been determined.
At the last minute, Javadov told Turan that one resident of this house was summoned to the Department for Combating Organized Crime of the Ministry of Internal Affairs in order to put pressure on him.—0—
