I`ve heard about judges who don`t read the cases under consideration, but I had to see it for the first time
Baku/12.04.23/Turan: In the photo, one of these judges is Parviz Zamanli, a judge of the Khatai Court of Baku. He has been unable (or unwilling) to deal with the claim of the tenants of the apartment building (Qurban Khalilov st.5) to SOCAR's "Azerigaz" Production Association (PO) for 4 months. In fact, the talk is about adding a debt to residents for gas (more than 1,500 manats), which they did not consume. Documents confirming this have been submitted to the court.
Nevertheless, at four trials (from January to April 11, 2023), Parviz Zanamanli asks the plaintiff the same question: "What do you want? Submit a certificate with your requirements."
At the last trial on April 11, the judge was shown a copy of the tenants' claim, in which it is written in black and white what they are seeking: to demand that "Azerigaz" write off an existing debt.
The judge's reaction to this was, to put it mildly, strange: "But we don't have this document," he said in surprise, holding the lawsuit in his hands. That is, the judge admitted that he had not read the lawsuit in the case, which he has been considering for the fourth month!
I felt that I had made a mistake, the judge demanded that one of the residents' representatives leave the hall, who reminded the judge that the claim had already been made in the lawsuit.
Meanwhile, the judge talked quite nicely with the representative of "Azerigaz", who was 15 minutes late for the trial, and without asking went into the hall and sat down in his seat. Clearly "worried" about the absence of the "Azerigaz" lawyer, the judge twice told his assistant: "Find out where Rashad is?"
Rashad appeared and offered to transfer the case to the Commercial Court, despite the fact that this court had already considered the claim, returning it to the Khatai court.
Then the judge began to ask questions unrelated to the essence of the tenants' complaint. And at this, the fourth trial, the judge did not make any decision, saying that it would be announced on April 27. At the same time, he added that the case should be referred to the Supreme Court (?)
This is not the end of the adventures in the Khatai court. So, on the electronic portal of this court, among the cases considered by Parviz Zamanli, there is no information on this case (!), although there are already reports on other trials for April 12....
