KZGO urged the appeals court to justify Elchin Hasanov

Committee to Protect Civil Society (CPCS) appealed to the Baku Court of Appeal in connection with the forthcoming review of the case of journalist Elchin Hasanov, convicted to a year of hard labor on charges of hooliganism.

The criminal case related to the incident eighteen months ago, when Hasanov himself was attacked by the former head of the agency "Asiya" Jafar Jafarov. (The latter is now on trial on charges of extortion.) After the incident, Hasanov appealed to the police, and after some time Jafarov was arrested, but not on the complaint of Hasanov, and in connection with the facts of extortion. However, in March of this year, was initiated a lawsuit against the most Hasanov. Hasanov said that he is being persecuted for his journalistic and opposition activities. He is the deputy editor of the Sumgait Internet newspaper "Yukselish Namine» (yukselis.info). In addition, a member of the Supreme Majlis of PFPA and deputy head of the NGO "Legal Education of Sumgait Youth". The start  of lawsuit against Hasanov coincided with his publications on the topic of corruption and embezzlement in the army.

On June 1 court sentenced him to one year of corrective labor. On  June 20 the prosecutor appealed the protest and demanded to toughen the Article against  Hasanov, and sentence him him to 3.5 years in prison.

On July 15, the Baku Court of Appeal chaired by Aflatun Gasimov scheduled consideration of the protest of the prosecutor.

CPCS believes that the presentation of the protest on the last day of expiry  creates a lot of questions, because the prosecutor did not express dissatisfaction with the sentences. This reinforces the belief that filing a protest is a political motive.

 The CPCS also reminds to a gross violation during the investigation of the European Convention on Human Rights. Doing business on hooliganism in the General Directorate for Combating organized crime Ministry of Internal Affairs itself is a gross violation of the law. The charge has no legal basis.  There are  no witnesses to the incident. All the prosecution is based on the words of the victim.

 The CPCS considers the sentence unjustified and Nizami court asks the Court of Appeal to justify Hasanov.
